Disclaimer of warranty for Our Store website
We provide our website and its contents on an "AS IS" basis and make no warranty or representation regarding any product, either express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement, which are hereby expressly disclaimed, unless otherwise stated herein.
Errors on our website
Despite our efforts to ensure that the information on our website is accurate, complete and current, there may be instances when information about a product contains inaccurate or incomplete data, including data about the product's price or availability. We make no warranty or guarantee that the information on our website is error-free, complete, or current. We reserve the right to correct errors and/or update the content on our website at any time without notice. We also reserve the right to refuse or cancel any order containing any error or inaccuracy, including after the order has been submitted, whether or not the order has been confirmed and your credit card charged. If your order is canceled after your payment has been processed, we will issue a full refund to the original pay type.

State sales taxes are charge for mail order and hand deliveries within Tennessee only.
We try to show our products in their true colors. Due to the differences in settings of computer displays the colors you actually see may be little different from the actual product.
Singing Telegrams & Party Entertainers
We wish to express that it is not our intention to violate any copyright laws. The characters that we offer are NOT name brand copyrighted characters, and we make no attempt to market them as such. The characters that we have are of our own creation. Any resemblance to nationally known copyrighted characters is strictly incidental and unintentional. None of these costumes have appeared in any movies, on television, as an animated personality, or in any publication. Our characters may not be advertised in any way, shape, or form as a copyrighted character. Advertisement of ‘costumed character’ with a general reference such as ‘friendly green dinosaur’ may be used. TERMS AND CONDITIONS Deposits and fees are non-refundable, once availability has been confirmed. Balance is due upon booking. If event is canceled, Celebrate the Day must be notified in writing. No refunds will be given if purchaser cancels a confirmed booking. There are no guarantees that we will be able to provide a character if you decide to change the date, due to weather or for any other reason. We will make a reasonable attempt to do so, but if we do not have a character available for your changed date/time/location, then the event is considered canceled by the purchaser, and there will be no refund.
If you have placed an order for 10 or more of the same item, or if the item is "Special Order" as listed on the page where it is ordered, a cancellation is NOT possible. *All Decorating Kits are subject to a 25% (minimum $5) restocking fee. Item must be in original package, unopened. Customer responsible for return shipping costs. Of course, Original shipping fees are non-refundable.
We can change or cancel your order if the above does not apply to your order. To do so, please contact us immediately with an explanation of your request in writing. Your request must be submitted by email.
We do not ship internationally because the package can not be tracked by the United States Postal Service.
Priority Mail usually takes 2-3 days for delivery. UPS Ground service averages 3-5 days in the U.S. If you need something by a certain date and have less than 10 days, we strongly recommend their 2nd Day or Next Day service instead.
Please make sure your ship-to address is correct and includes an apartment number if needed. We will have to charge for reshipping your package back to you if the address you provided was incorrect.
Please make arrangements if you are moving and won't be at the location you are shipping to. We are not responsible if your package is delivered to you after you have moved, if your package is delivered to an empty home/apartment because you hadn't moved in yet, or is left with apartment office staff who lost it!
We are not responsible if a carrier leaves your package unattended at your residence, office, front desk, etc. and it is lost or stolen.
We are not responsible if you failed to receive a notice that your package was at the post office and it got returned to us. We will have to charge for reshipping your package back to you.
We will leave the gifts at the place of business when the recipient is absent from the business as long as there is someone at the place of business to receive the delivery.
We must make phone contact with the recipient or someone at the residence where the order is to be delivered prior to delivery. This may result in the delivery being made later than the scheduled delivery time. We make every effort not to spoil the surprise of a gift delivery; however, this can be difficult for residential deliveries since contact is necessary prior to making the delivery.
If you prefer that we not call ahead as directed above, but rather proceed with the delivery and leave the gifts outside the residence if no one answers, we will do so. However, we will not accept responsibility and will not offer a refund or credit if the balloons and gifts are stolen, popped, blown away, or otherwise damaged as a result of being left outside. We only offer this delivery service to free-standing residences with front and back yards.
Cancellation for purchases under $100
For a full refund, the deadline to submit your request is 10am, Central Time (Tennessee), five days prior to delivery.
Orders cancelled or changed after this deadline are subject to a cancellation charge ranging from $20 to 100% of the order value, depending on the extent of preparations made for the order.
We are unable to cancel or change an order on the date of delivery.
Cancellation for purchases over $100
For a full refund, the deadline to submit your request is 10am, Central Time (Tennessee), five days prior to delivery.
Requests received after this deadline are subject to a cancellation charge ranging from 25% to 100% of the order value, depending on the extent of preparations made for the order.
We are normally unable to cancel or change an order on the date of delivery.
There will be a $10 changing fee assessed to all orders making changes within 2 days of delivery. In some cases, a change may not be able to take place.
Celebrate the Day delivers quality balloon decor. Cost of Balloon Decor involves design time, scheduling, labor, materials and installation.
We cannot guarantee products after delivery or in adverse weather conditions.
Celebrate the Day cannot be responsible for crowds touching decor or for staff handling or attempting to move decor. No refunds possible.
*HOW TO CANCEL AND CHANGE
Please send your request by email to email@example.com and call our store (615) 613-3282. Please consider your order canceled or changed only when you have received a confirmation by email.
If Celebrate the Day is unable to deliver an order due to inclement weather, the customer will be notified as soon as possible to arrange for rescheduling or a cancellation and refund.
Balloons look their best and last longer indoors. By nature, they are sensitive and can pop. Avoid exposing balloons to extreme heat, as this could cause the balloon to burst. Before releasing a group of latex balloons to float on the ceiling, release two or three as a test - the invisible fiber particles in acoustical ceiling tiles can pop balloons. Latex balloons are 100 percent natural substances that will biodegrade both in sunlight and water. Foil balloons are not biodegradable. Do not release foil balloons outdoors or near electric power lines. Foil balloons may conduct electricity. Foil balloons could appear deflated in cold air and will fill out when warmed up.
Children under 8 years of age can choke or suffocate on un-inflated or broken balloons. Discard broken balloons immediately! Adult supervision required.
Due to the display settings of your monitor, colors may vary slightly. We attempt to be as accurate as possible to the physical color of all items.
Out of Stock Items and Shipping Upgrades
All customers will receive an e-mail confirmation to confirm the order, usually less than an hour after the order was placed during business hours. Items out of stock, time in transit, shipping upgrade information will be provided. PLEASE READ! When there are items on the order out of stock, we typically can get those items in within 2-3 days. We ask that you respond to confirm the expected shipping date will work with the event schedule. If we do not hear from you by e-mail and were not provided with your contact number when you placed the order, we will assume all is okay and order anything out of stock for your order.
When a customer requests an upgrade in shipping or would like to add something to the original order, we MUST receive payment by phone or payment using PAYPAL. Paypal does NOT initiate payments for you. When we send you an invoice by email, it is required to log in to your account and authorize the payment amount. If we know your event date is approaching and have tried contacting you by all means provided, we will NOT ship merchandise that has NOT been paid for or if a shipping upgrade was requested to receive the merchandise on or before the event, we will remove items from the order to cover the shipping costs.

**Celebrate The Day is not responsible for lost, stolen, or damaged packages. In the event you receive a damaged package or you do not receive your package at all, contact us and we'll process a claim with the shipping carrier.**
If you are unhappy with any part of your order, contact our customer service representatives by email, fax or phone within 30 days from the date your order is placed and you will be issued an RMA number. All returns must be received no later than 30 days from the day your order is placed. You must have an RMA number for your return to be accepted. Returns received without an RMA number will be subject to a 50% restocking fee. Please have the following information readily available before contacting celebratetheday.biz for an RMA: Date of Purchase, Order Number and List of Items for Return.
All returns must be received within 10 days of issuance of the RMA number and no later than 30 days from the day your order is placed. Returnable items must be unopened and in original condition. All items not in resellable condition will not receive a credit.
Seasonal, holiday, food service items, inflatable centerpieces, hand air inflators/pumps, balloon decorating kits, clearance, special orders and limited quantities are non-returnable. Items purchased as a party package cannot be returned separately. A 25% restocking fee or minimum of $5.00 will be charged on all returns.
Celebrate The Day is not responsible for lost, stolen, or damaged items due to return shipment handling. It is recommended that all returns are shipped back with insurance coverage and delivery confirmation. We do not reimburse for shipping charges. Refused and unclaimed shipments will be charged a 50% restocking fee in addition to inbound and out bound freight charges. Please allow 1 credit card billing periods for all credits to be posted.
Send returns with a copy of your invoice with the RMA number on it and the RMA number clearly marked on the outside of the package to:

All of our shipping methods have insurance coverage. Damage MUST be reported to staff at Celebrate The Day. If your package was shipped UPS, you must call them at 800-PICKUPS (742-5877) within 48 hours of receipt. Return or Refunds for Damage reported after this time are NOT allowed! If your package was shipped USPS, take the package to the post office and fill out a claim form.
Merchandise is inspected when we receive it from our suppliers. Noticable defective items are removed from any stock we sell to customers. We are NOT responsible for damage caused through shipping by any carrier. When you receive your package, inspect the outside of the package as well as the merchandise inside. If there are any problems, call or e-mail us immediately and contact UPS to pick up the package.
We are NOT responsible for damage caused when balloons are inflated by someone other than staff at Celebrate The Day. Some foil balloons may have come from the manufacturer with a tiny hole in the foil. We couldn't have any idea there is a problem unless we inflate each balloon before shipping. And that is an impossible task. A hole can be repaired with a piece of clear shipping tape. We have done this several times in the past on local decorating and balloon delivery jobs.
We are NOT responsible when incorrect names, addresses (local delivery or mail order) have been provided to us. UPS will charge us a $10 address correction fee. You will be responsible for this fee if you provided incorrect information. We appreciate your patience and cooperation.
